Lenape Resources has made good on their threat to sue the DEC. They just don’t say why exactly. Nor is it clear from reading their complaint. Plus they are claiming damages for voluntarily turning off their own wells. (Why didn’t I ever think of that when gas prices were down ?) And damages for all the money they might have made prospecting for dry shale gas at the fringe of the Marcellus and Utica, if they had new permits to do so - from the DEC - who they just sued. Makes sense, right ? As a fracking publicity stunt. Lenape’s attorney, Michael Joy, who is neither a real estate nor a land use lawyer, has evidently not bothered to read the Dryden, Middlefield, or Binghamton decisions (which are not even […]

Dryden Rent-a-Plaintiff DOA

The Rent-A-Plaintiff in Anschutz v Dryden , Norse Energy, a gas prospector in New York, is functionally comatose as of Q4 2012. Which means one of two things: either frack flak Tom West has to wheel them to the appellate court on a gurney with an IV full of fracking flowback stuck in their arm, or he will have to find yet another plaintiff (with a pulse) in order to perfect an appeal against in Dryden. Can’t be Gastem, they’re history. Could be Johnny Hole Co. - their bullying threats to the DEC certainly fit the pattern. Mike “Road Kill” Knapp’s fracking company might be suitably disreputable. Not by Chesapeake, not by Norse Energy, not by nobody. No surprise there, since most people in Upstate have little upside in getting fracked - they don’t own enough land to play the shale gas lotto nor do they own a trailer park that caters to transient workers. But they may own a house near a road or depend on a shallow water well. Or live next to land that has been leased. So they have little or no economic upside. Home Rule applies to Fracksylvania frackers

Pennsylvania court strikes down the provisions of Act 13 that gutted local land protections. In a 4-3 opinion, the PA Commonwealth Court sided with the people and local communities of Pennsylvania by striking down large portions of Act 13 - a law passed in February at Chesapeakes’s behest which severely restricted the ability of local communities to use their home rule powers to protect housing and water wells from shale gas industrialization. “Frack Us” resolutions put towns at risk because they rely on regulations that were written by Chesapeake. For Chesapeake, not the town. The DEC just takes notes. 1. The DEC cannot protect any roads. The DEC is not empowered to protect town roads, county roads, or state roads.[1] The protection of town roads is totally up to the town, not the county, not the state.[2] If the town fails to enact a road use ordinance, the taxpayers will be obligated to pay to repair damage done by frack trucks,[3] the drillers are not liable for such repairs, absent a town ordinance. 2. Most Residents Don’t Benefit From Fracking

In a recent study done by Penn State, researchers discovered that the majority of residents in rural Pennsylvania will not benefit from shale gas exploration - because they do not own enough land to lease - and they are unlikely to find jobs working as transient laborers on oil rigs. And in Pennsylvania, absent local ordinances, the majority of voters are disenfranchised: they don’t have enough land to participate in the shale gas lottery, they are not likely to find employment on rigs, and they can’t vote about it - since the state has deprived them of local land use protections.
