Or in the case of LNG export terminals - trivialize the review process by handing it off to the most obscure group inside the DEC - the “Remediation” team - ie. the clean-up squad. Which, in the event of an LNG terminal disaster, would be the guys in the yellow HAZMAT suits picking up char-broiled body parts. If there is any doubt about who is pushing this (hint: rhymes with crackers) or why (hint: rhymes with funny), just read what they have drafted as “regulations” for LNG facilities in New York. New York’s proposed LNG permitting rules were written by the frackers. That’s clear from just skimming them. There are virtually no requirements on siting - no setbacks from residences or other businesses, no venting limitations, and comically dinky permit fees. The New York Joint Landowners Coalition of New York - JLCNY ( a Koch Sock Puppet front group) has issued yet another summary about their proposed lawsuit against the state of New York - wherein they must prove at trial that “the state has deprived them of all economic use of their property.” Simply because the state regulators are still in the process of reviewing the proposed regulations for one type of oil and gas well - which has never been drilled in the state, and which has proven problematic elsewhere - namely high water volume hydraulically fractured horizontal wells, (HVHF). Leave for appeal has been granted for the New York high court to hear the appeal of the plaintiffs in the Dryden and Middlefield Home Rule cases.
