For forty (40) fracking years. The Koch Brothers’s Fracking Front Group, the (Rocky) “Mountain States Legal Foundation” is not just bankrolling the Fracking Reparations Publicity Stunt against the State of New York, they are writing the threatening demand letters – from Lakewood, Colorado. Catch is they are about 40 years late to be complaining about the DEC’s failure to update it regulations. Since that’s how long the industry has been lobbying New York to keep those regulations from being updated and promulgated. If this strikes you as more than a bit ironic, you’d be right.
The Koch Brothers are now demanding the DEC finish the SGEIS, when the gas industry has successfully worked with the Division of Mineral Resources to keep the updates unfinished since 1972. As Brian Brock has explained, with his FOIL’d documents, the DEC’s Division of Mineral Resources even claimed they lost the proposed GEIS revisions. So the DEC has been dragging its feet on revising its regulations for literally 40 years – as explained here – at the frackers’ behest.
When it came time to comment on the proposed revised regulations,the DEC received over 220,000 comments – mainly from fractavists. The NYS gas industry, by contrast, submitted a handful of tepid comments – and none from the Koch Frack Front – who is now threatening the agency, but, as a Colorado lobbying group, have no standing in New York to be threatening anybody. The putative plaintiff in this PR stunt is Norse Energy, a bankrupt Frack Zombie Rent a Plaintiff. That’s what passes for a “responsible fracker” in Old New York. That’s what the frack lobby has been reduced to in this state- PR stunts via lawsuits.

But then, this really isn’t going to court is it ? This is going to the next headline on a slow news day. And here’s the headline: The gas industry is threatening to sue the DEC for doing it’s job – not promulgating regulations– at the behest of the gas industry. Imagine that.
By threatening their lapdog agency the frackers might just force the DEC to finally promulgate and enforce regulations. What a curious outcome that would be.
