Team Cuomo has taken New York the edge of the Fracking Cliff. One more push and Upstate water gets contaminated with frack poop. How did that come about ? They Cuomo Administration has done a nice job at equivocating as to what it might do to protect New York from the hazards of fracking, but here is where we are really at, as we peer over the Fracking Cliff:
Even a casual perusal of the proposed regulations will show that they are much ado about fracking, and precious little about environmental protections, because they are first and foremost written for the gas industry lobbyists and will be administered by the Mineral Resources group at the DEC – who have environmental oversight over fracking. The fracking fox guards the environmental hen house.
2. The proposed fracking regulations has been issued before the dSGEIS or health study is complete because the SGEIS is, as a regulatory document, primarily environmental gerrymandering and the health study is just for show.
There is a rather straightforward explanation for this: the dSGEIS and the health study don’t matter much. The dGEIS is fundamentally an exercise in environmental gerrymandering – geopolitical carve–outs from the regulations based on population density, ie. votes. If your water supply gets enhanced protections under the SGEIS, then you are less threatened by the fracking regulations – you have some localized protection from fracking. If you do not get special protections under the SGEIS, then for all practical purposes the SGEIS is meaningless – because it affords you no protection from the fracking regs.
And what about the health study ? What about it ? It will simply be tacked on as an appendix to the SGEIS. That’s it. The health study will not inform or influence the fracking regulations – because the fracking regulations have already been issued.
3. New York State will go over the Fracking Cliff a gas colony of Texas and Okalhoma
New York state will go over the Fracking Cliff with no state severance tax on gas at the wellhead – one of the few places on the planet where gas production is untaxed by the state. It will go over the Fracking Cliff with Home Rule still in the courts. And it will go over the Fracking Cliff with what is fundamentally a 40 year old set of fracking rules, and no autonomous environmental oversight over fracking. . .
